Gebruiksvoorwaarden (EULA)

Deze gebruiksvoorwaarden zijn van toepassing op het gebruik van Serve POS, ontwikkeld en aangeboden door Robocom bv, België ("wij", "ons"). Door de app te installeren of te gebruiken, aanvaardt u deze voorwaarden.
Serve POS is bestemd voor gebruik door organisaties, verenigingen (met of zonder rechtspersoonlijkheid), en beroepsmatige gebruikers, en niet voor gebruik door consumenten in de zin van consumentenbeschermingswetgeving.
1. Licentie
Wij verlenen u een persoonlijke, niet-exclusieve, niet-overdraagbare licentie om Serve POS te gebruiken op toestellen die u bezit of beheert, uitsluitend voor intern gebruik binnen uw organisatie. Het is niet toegestaan de app te reverse-engineeren, te kopiëren, te verhuren of door te verkopen.
2. Proefperiode
Na installatie heeft u 60 dagen gratis toegang tot alle functies van Serve POS. Er is geen creditcard of betaling vereist om de proefperiode te starten.
3. Abonnement na proefperiode
Na afloop van de proefperiode is een actief abonnement vereist om de app te blijven gebruiken. Abonnementen worden beheerd via de respectieve app store (Google Play of Microsoft Store). De prijs, facturatiefrequentie en herroepingsrechten worden bepaald door de store-voorwaarden die van toepassing zijn op uw aankoop.
4. Verlopen proefperiode zonder abonnement
Wanneer de proefperiode verloopt en er geen actief abonnement is, wordt de app geblokkeerd. Uw gegevens blijven bewaard op het toestel. Zodra u een abonnement activeert, is de app opnieuw volledig beschikbaar inclusief alle eerder ingevoerde gegevens.
5. Intellectuele eigendom
Serve POS en alle bijbehorende software, ontwerpen en documentatie zijn eigendom van Robocom bv en beschermd door het auteursrecht. Deze overeenkomst verleent u geen eigendomsrechten op de software.
6. Fiscale verantwoordelijkheid
Serve POS is geen gecertificeerd fiscaal kassasysteem en voldoet niet aan de eisen van gecertificeerde kassasystemen zoals het Belgische Geregistreerd Kassasysteem (GKS) of gelijkaardige wettelijke vereisten in andere landen. De gebruiker is als enige verantwoordelijk voor de naleving van alle toepasselijke fiscale en boekhoudkundige verplichtingen in zijn land, waaronder eventuele verplichtingen tot gebruik van een gecertificeerd of gecertificeerd kassasysteem. Robocom bv aanvaardt geen aansprakelijkheid voor fiscale boetes, naheffingen of geschillen die voortvloeien uit het gebruik van Serve POS, ongeacht het land van gebruik.
7. Aansprakelijkheidsbeperking
Serve POS wordt aangeboden "as is", zonder enige garantie. Robocom bv is niet aansprakelijk voor enig direct, indirect, incidenteel of gevolgschade die voortvloeit uit het gebruik of de onmogelijkheid tot gebruik van de app, met inbegrip van maar niet beperkt tot verlies van inkomsten, gegevensverlies of bedrijfsonderbreking.
In elk geval is de totale aansprakelijkheid van Robocom bv beperkt tot het bedrag dat u in de afgelopen 12 maanden voor de app heeft betaald.
8. Wijzigingen
Wij behouden ons het recht voor deze voorwaarden op elk moment te wijzigen. Bij wezenlijke wijzigingen brengen wij u op de hoogte via de app of de app store. Voortgezet gebruik na kennisgeving geldt als aanvaarding van de nieuwe voorwaarden.
9. Beëindiging
U kunt uw abonnement op elk moment opzeggen via de app store. Na beëindiging blijft uw toegang actief tot het einde van de betaalde periode. Robocom bv behoudt zich het recht voor de licentie te beëindigen bij schending van deze voorwaarden.
10. Toepasselijk recht
Deze overeenkomst wordt beheerst door het Belgische recht. Geschillen worden exclusief voorgelegd aan de bevoegde rechtbanken van België.

Les présentes conditions d'utilisation s'appliquent à l'utilisation de Serve POS, développé et proposé par Robocom bv, Belgique (« nous »). En installant ou en utilisant l'application, vous acceptez ces conditions.
Serve POS est destiné à une utilisation par des organisations, associations (avec ou sans personnalité juridique) et utilisateurs professionnels, et non à une utilisation par des consommateurs au sens du droit de la protection des consommateurs.
1. Licence
Nous vous accordons une licence personnelle, non exclusive et non transférable pour utiliser Serve POS sur les appareils que vous possédez ou gérez, uniquement pour un usage interne au sein de votre organisation. Il vous est interdit de désassembler, copier, louer ou revendre l'application.
2. Période d'essai
Après l'installation, vous bénéficiez de 60 jours d'accès gratuit à toutes les fonctionnalités de Serve POS. Aucune carte de crédit ni paiement n'est requis pour démarrer la période d'essai.
3. Abonnement après la période d'essai
À l'expiration de la période d'essai, un abonnement actif est nécessaire pour continuer à utiliser l'application. Les abonnements sont gérés via le store concerné (Google Play ou Microsoft Store). Le prix, la fréquence de facturation et les droits de rétractation sont déterminés par les conditions du store applicables à votre achat.
4. Expiration sans abonnement
Lorsque la période d'essai expire et qu'aucun abonnement actif n'est en place, l'application est bloquée. Vos données restent conservées sur l'appareil. Dès que vous activez un abonnement, l'application est à nouveau entièrement disponible, y compris toutes les données précédemment saisies.
5. Propriété intellectuelle
Serve POS et tous les logiciels, designs et documentations associés sont la propriété de Robocom bv et sont protégés par le droit d'auteur. Le présent accord ne vous confère aucun droit de propriété sur le logiciel.
6. Responsabilité fiscale
Serve POS n'est pas un système de caisse fiscalement certifié et ne satisfait pas aux exigences des systèmes de caisse certifiés tels que le Système de Caisse Enregistreuse (SCE) belge ou toute exigence légale équivalente dans d'autres pays. L'utilisateur est seul responsable du respect de toutes les obligations fiscales et comptables applicables dans son pays, y compris toute obligation d'utiliser un système de caisse certifié. Robocom bv décline toute responsabilité pour les amendes fiscales, redressements ou litiges découlant de l'utilisation de Serve POS, quel que soit le pays d'utilisation.
7. Limitation de responsabilité
Serve POS est fourni « en l'état », sans aucune garantie. Robocom bv ne peut être tenu responsable de tout dommage direct, indirect, accessoire ou consécutif résultant de l'utilisation ou de l'impossibilité d'utiliser l'application, y compris, sans s'y limiter, la perte de revenus, la perte de données ou l'interruption d'activité.
En tout état de cause, la responsabilité totale de Robocom bv est limitée au montant que vous avez payé pour l'application au cours des 12 derniers mois.
8. Modifications
Nous nous réservons le droit de modifier ces conditions à tout moment. En cas de modifications substantielles, nous vous en informerons via l'application ou le store. La poursuite de l'utilisation après notification vaut acceptation des nouvelles conditions.
9. Résiliation
Vous pouvez résilier votre abonnement à tout moment via le store. Après résiliation, votre accès reste actif jusqu'à la fin de la période payée. Robocom bv se réserve le droit de résilier la licence en cas de violation des présentes conditions.
10. Droit applicable
Le présent accord est régi par le droit belge. Les litiges sont soumis exclusivement aux tribunaux compétents de Belgique.

These terms of use apply to your use of Serve POS, developed and offered by Robocom bv, Belgium ("we", "us"). By installing or using the app, you accept these terms.
Serve POS is intended for use by organisations, associations (with or without legal personality), and professional users, and not for use by consumers within the meaning of consumer protection legislation.
1. License
We grant you a personal, non-exclusive, non-transferable license to use Serve POS on devices you own or control, solely for internal use within your organisation. You may not reverse engineer, copy, rent, or resell the app.
2. Trial Period
After installation, you have 60 days of free access to all features of Serve POS. No credit card or payment is required to start the trial period.
3. Subscription After Trial
After the trial period expires, an active subscription is required to continue using the app. Subscriptions are managed through the relevant app store (Google Play or Microsoft Store). Pricing, billing frequency, and withdrawal rights are governed by the store terms applicable to your purchase.
4. Expired Trial Without Subscription
When the trial period expires and no active subscription is in place, the app is blocked. Your data remains stored on the device. Once you activate a subscription, the app is fully available again including all previously entered data.
5. Intellectual Property
Serve POS and all associated software, designs, and documentation are owned by Robocom bv and protected by copyright. This agreement does not grant you any ownership rights in the software.
6. Fiscal Responsibility
Serve POS is not a fiscally certified cash register system and does not meet the requirements of certified cash register systems such as the Belgian Registered Cash Register System (GKS) or equivalent legal requirements in other countries. The user is solely responsible for compliance with all applicable fiscal and accounting obligations in their country, including any obligation to use a certified cash register system. Robocom bv accepts no liability for tax penalties, assessments, or disputes arising from the use of Serve POS, regardless of the country of use.
7. Limitation of Liability
Serve POS is provided "as is", without any warranty. Robocom bv shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the app, including but not limited to loss of revenue, data loss, or business interruption.
In any event, Robocom bv's total liability is limited to the amount you have paid for the app in the preceding 12 months.
8. Changes
We reserve the right to modify these terms at any time. For material changes, we will notify you via the app or the app store. Continued use after notification constitutes acceptance of the new terms.
9. Termination
You may cancel your subscription at any time through the app store. After cancellation, your access remains active until the end of the paid period. Robocom bv reserves the right to terminate the licence in the event of a breach of these terms.
10. Governing Law
This agreement is governed by Belgian law. Disputes shall be submitted exclusively to the competent courts of Belgium.
